CREDITOR’S RIGHTS
The Law Offices of Shannon J. Posner, P.A. represents financial institutions and other commercial creditors in connection with commercial workouts, modifications and/or restructurings. The Firm regularly practices in a full range of creditor’s rights matters such as restructuring and/or modifying distressed commercial loans, recovering collateral and liquidating assets.
For more than five (5) years, we have handled hundreds of workouts, modifications and/or restructurings. At any given time, it is not unusual for the Firm to be handling between 50 to 100 separate workout matters for a diverse group of clients ranging from national and regional commercial financial institutions to community banks.
We are experienced in virtually all aspects of commercial workouts, modifications and/or restructurings. Our broad transactional experience and extensive form files enable us to efficiently handle “soft” workouts involving the restructure or modification of virtually any type of commercial credit facility. In situations in which our client seeks to exit a credit facility, our many contacts in the lending industry enable us to identify other lenders who might be willing to purchase or refinance the credit facility.
We can also provide a full range of services for more distressed credits, including, without limitation, negotiating forbearance agreements, recovery of collateral and liquidation of assets. We have conducted numerous foreclosure sales and liquidations throughout the Mid-Atlantic region involving various types of collateral including real estate, machinery and equipment, inventory and a variety of other types of commercial assets. |
